      Detailed Rules for Implementation

      toDeepen Urban Renewal and Promote High-Quality Development in Zengcheng District

      In order to further improve the supporting measures for urban renewal and promote high-quality development with high-quality urban renewal, these Detailed Rules are formulated in accordance with theImplementation Opinions on Deepening Urban Renewal and Promoting High-quality Development(Sui Zi [2020] No.10) and other documents, combined with the actual situation of Zengcheng District.

      1. Strengthen the review of the implementation plan of the old village renovation project

      (1)Review the effectiveness of the old village target map database. The main body of transformation implementation should entrust a technical unit with Grade A surveying and mapping qualification to check the effectiveness of the plotting database of "three old" transformation of old village, old factory and old town before the project implementation plan is reviewed. The review report serves as the basis for land preparation of the implementation plan.

      (2) Make clear demolition and reclamation audit procedures. If the old village renovation project involves demolition and reclamation, the main body of renovation implementation shall prepare the demolition and reclamation plan, which shall be used as the basis for land preparation of the implementation plan after being approved by experts organized by the Planning and Natural Resources Department of district. In principle, the scale and index turnover of new construction land are not arranged in the area, and the existing construction land should give priority to the construction and resettlement of district and public service facilities.

      (3) Strictly control the scale of new construction land. In principle, the scale of new construction land shall not be arranged for the old village reconstruction project except for the "three places", the landing of the reserved land index and the supplementary recording of the "three old" reconstruction map. After being examined and approved by the Planning and Natural Resources Department of district, the revised plan of the relevant land use master plan will serve as the basis for implementing the land preparation of the plan. In the later implementation process, the planning and natural resources departments of district implemented the revision plan in stages according to the construction time sequence through the preparation of land and space planning.

      (4) Ensure the safety of soil environment. If it is necessary to carry out soil environmental investigation and assessment according to the requirements of relevant documents on soil pollution prevention and control management, the main body of transformation implementation shall provide a letter of commitment including completing the review of investigation and assessment report before land supply, and completing content such as control and restoration in strict accordance with the requirements before land supply if contaminated land is involved, and then the approved implementation plan can be given.

      (5)Adjust the listing time of bidding (investment promotion). The announcement time for the introduction of cooperative enterprises through public bidding for old village reconstruction projects and the introduction of cooperative enterprises through investment shall be no less than 30 natural days respectively.

      2. Improve the implementation mechanism of the old village reconstruction project

      (6) Strengthen the investigation and management of basic data. District Planning and Natural Resources Department and township (sub-district) government should strengthen the management of basic data investigation, further optimize the investigation mechanism, and make a good connection between the basic data results of old village reconstruction and the registration results of "integration of real estate and land". Village collective economic organizations or cooperative (intentional) enterprises that interfere with basic data investigation and resort to deceit shall cancel the qualification of old village reconstruction, and seriously investigate the relevant main responsibilities.

      (7) Establish the old village comprehensive transformation market area price evaluation system. The Planning and Natural Resources Department of district organizes the price evaluation of areas in the comprehensive renovation market of old villages in the district, and the relevant results are regularly updated and published every year. The implementation plan of the old village reconstruction project takes the published area price (technically revised according to the floor area ratio, etc.) as the accounting basis for the financing area. If the area price of residential areas in village is lower than the average price of the whole district, in principle, the application for renovation of old villages will not be accepted (except for old villages that have been included in district Old Village Renovation Project Database and key areas led by the government).

      (8) Make clear upfront costs included in the transformation cost standard. The evaluation fee of financing land price for calculating financing area witharea price is 300,000 yuan/project, the compensation for moving is 4,000 yuan/countable building, and the migration fee such as telephone and television is included in the renovation cost according to 550 yuan/countable building; Basic data survey fees, land survey and demarcation fees, and district planning scheme preparation fees (including regulatory detailed planning scheme preparation fees) are included in the renovation cost according to the government bidding contract and the actual payment amount, but shall not exceed the cost accounting standard for comprehensive renovation of old villages in Guangzhou.

      (9) Strengthen industrial introduction. The whole region is divided into three industrial circles according to key functional areas, land value and other factors. In principle, the industrial construction amount of old village reconstruction projects in the first, second and third circles is not less than 25%, 15% and 10% of the total project construction amount respectively, or the industrial construction amount of financing plots is not less than 30%, 20% and 15% of the total financing construction amount respectively. The old village reconstruction project should improve the industrial entry threshold, improve the quality of imported industries, and strengthen the supervision of industrial introduction. Specifically, the Planning and Natural Resources Department of district should formulate relevant management measures with the competent industrial department of district.

      (10) Give priority to the construction of government housing. The government houses allocated for the old village reconstruction project should be given priority to centralized construction. The housing and urban-rural construction departments of township (sub-district) and district, and the planning and natural resources departments of district should specify the area, location and use of the houses in the detailed planning scheme of the project according to the government's use needs. With the consent of the district government, if the government housing is built by the main body responsible for the transformation, the housing index can be deducted from the construction and installation expenses according to the market evaluation price.

      (11) Standardize the reserved land into the old village reconstruction procedures. If the old village renovation project cannot achieve the balance of funds due to the restriction of land use and planning conditions, other land within the scope of ownership of the village that conforms to the overall planning of land and space can be included in the scope of renovation, and the debt index of reserved land can be deducted. If the index is insufficient, the index of reserved land can be applied for advance. Involving the advance reserve land index, it is necessary to sign the land acquisition agreement of the main plot and report it to the district government, city planning and natural resources department for approval in accordance with relevant regulations, and then the approved implementation plan can be given.

      (12) Make clear supporting requirements for educational facilities. If the old village reconstruction project is small in scale and educational facilities are allocated according to the planned population to produce schools with small scale, poor conditions and low quality, the educational facilities can be coordinated regionally with the consent of the education departments of township (sub-district) and district. The per capita construction area of educational facilities shall be allocated by 25-50% according to the standards of Guangzhou Urban and Rural Planning Technical Regulations; In principle, the average land area per student is allocated according to the standard of areas outside the central city in the Technical Regulations on Urban and Rural Planning of Guangzhou. After being fully demonstrated and reported to the Education Department of district for approval, it can be allocated according to the median value of not less than the downtown area and areas outside the downtown area.

      (13) Protect the villagers' right to know and vote. In the process of submitting the implementation plan for approval and voting, Demolition compensation and resettlement standards (individual and collective), Collective construction land is transferred to state-owned construction land, other non-construction land is expropriated into the scope of transformation (deduction of retained land debt index, advance retained land index), conversion of retained land index into collective property standard, resettlement of district site selection and land supply objects, general layout design drawings and other matters involving villagers' vital interests should be explained to villagers in detail. As an independent matter, it will be voted by the representative meeting of members of collective economic organizations in village and form a summary, and the relevant content and voting will be publicized for 5 natural days.

      3. Strengthen the implementation and management of old village reconstruction projects

      (14) Strengthen the management of project signing and approval. After the implementation plan was reviewed and approved by the district Urban Renewal Leading Group Meeting, township (Sub-district) instructed village collective economic organizations and transformation implementers to sign the demolition compensation and resettlement agreement. The implementation plan can only be approved for projects with an overall signing rate of more than 50%.

      (15) Promote the demolition and construction of key projects. After the old village reconstruction project is introduced into the cooperative intention enterprise, before the implementation plan is approved and takes effect, if it involves the construction of large-scale municipal supporting facilities, public service facilities and key industrial projects, the cooperative (intention) enterprise shall first assist the township (sub-district) to carry out the demolition construction and be responsible for the relevant expenses, which shall be included in the reconstruction cost in line with the urban renewal policy.

      (16) Strengthen the pre-sale control of financing area. After the implementation plan comes into effect and the resettlement district and public service facilities start construction, the financing district can be constructed simultaneously. The construction progress of resettlement district must be faster than that of financing district. On the premise of meeting the requirements of relevant documents and ensuring the successful completion of the project resettlement district and public service facilities, the pre-sale of some financed commercial houses is allowed, and the Planning and Natural Resources Department of district takes the lead in formulating relevant operational regulations.

      4.Promote the transformation of old factories into pieces

      (17) Review the effectiveness of the old factory building project target map database. District planning and natural resources departments should entrust technical units with Grade A surveying and mapping qualifications to review the effectiveness of the "three old" reconstruction maps before the approval of the implementation plan. The effective part after review can be applied to the urban renewal policy. After review, if the part of the plotting database that does not meet the latest warehousing conditions is transformed according to the government's purchasing and storage methods, the compensation can be calculated with reference to 80% of the compensation standard for the effective plotting database, but the total compensation shall not exceed 45% of the transaction price of public transfer.

      (18) Promote the transformation of old factories in key areas. Located along the main urban roads such as Guangshan Highway and Xincheng Avenue and the main urban areas of Licheng and Xintang, In addition to the compensation according to Article (17), the compensation for the part without plotting can be calculated with reference to 80% of the compensation standard for effective plotting, but the total compensation shall not exceed 45% of the transaction price of public transfer. In case of contiguous reconstruction of multiple adjacent plots, each owner shall obtain compensation according to the priority order of the valid plotting database building part, the plotting database building part that does not meet the latest warehousing conditions, and the non-plotting database building part.

      (19) Facilitate the construction of affordable housing. Located in the key areas listed in Article (18), the "industrial to residential" project shall be allocated with affordable housing free of charge according to 5% of the residential construction area of the project.

      (20) Delineate the negative list of old factory renovation. If the old factory land belongs to the following circumstances, the urban renewal policy shall not be applied:

      a. The plots within the industrial blocks do not meet the regulations on the management of industrial blocks after transformation;

      b. Plots that do not meet the latest warehousing conditions for the construction of the "three old" transformation map are transformed by themselves according to business purposes;

      c. The land that has been identified as idle has not been disposed of, or has been disposed of but has not implemented the disposal requirements;

      d. The land use right has been obtained for the first time after December 31, 2009 (except for plots with perfect land use procedures according to the urban renewal policy).

      5. Explore a high-quality urban renewal model

      (21) Support state-owned enterprises to participate in the transformation. Encourage state-owned enterprises in the district to participate in urban renewal according to law through capital operation and preliminary services, and focus on exploring the preliminary work such as the preparation of the implementation plan of the old village reconstruction project (including the compensation and resettlement standards for demolition) led by state-owned enterprises in the district, and then introduce market players to carry out demolition and construction by means of public listing and bidding. After the project is publicly listed and sold, the reasonable expenses incurred by the state-owned enterprises in the region will be returned, and the premium generated by public bidding can be specially supported for its development.

      (22) Promote the pilot old village transformation "combination of storage and reform". Old village reconstruction projects around urban main roads and important development platforms strengthen the "combination of storage and reform", and the government leads the scientific delineation of the scope of old village reconstruction and land purchasing and storage, and simultaneously carries out the reconstruction and purchasing and storage work. The reserved land generated by purchasing and storing land will be given priority to balance the intensity of renovation and development of old villages. The "combination of storage and reform" project gives village collective property rewards according to the square meter standard of 10 per mu of government reserve land, and the construction cost is self-raised by village collective economic organizations, which is not included in the renovation cost.

      (23) Explore the government-led model of old city reconstruction. If more than 90% (inclusive) of the property owners in the old city reconstruction area agree to the reconstruction, After the government takes the lead in organizing the basic data investigation, compiling the implementation plan (including the compensation and resettlement standards for demolition) and determining the development and construction conditions, the demolition task and the right to use the land to be reconstructed will be publicly listed to determine the main body of reconstruction, and the house demolition will be implemented when the compensation and resettlement agreement for demolition reaches more than 90% (inclusive), and the transfer contract will be signed when the contract reaches 100%. The contiguous reconstruction project of the old city can be implemented flexibly and dynamically by stages with reference to the old village project.

      (24) Facilitate the implementation of plot ratio balance in different places. If the average net floor area ratio of residential (including commercial and residential) land in the old village reconstruction project exceeds 4.5, the excess should be balanced in different places by means of transfer of financing area development rights and interests. The main body of transformation implementation can undertake the corresponding financing area development and transfer rights and interests according to the principle of equivalent value (calculated by area price in the comprehensive transformation market of old villages) by publicly competing for the business land reserved for the transformation of old villages in different places.

      6. Others

      (25) Strengthen supervision and management. Township (Sub-district) and relevant functional departments should strengthen the supervision of urban renewal, focusing on the introduction of cooperative enterprises in old village reconstruction, industry introduction, scheme approval, implementation of supervision and other aspects to strengthen the system construction, and effectively prevent the risk of clean government. The relevant departments shall be seriously accountable and resolutely investigate and deal with violations of discipline and discipline in the process of transformation; If it constitutes a violation of the law, the relevant subjects shall be investigated for responsibility according to law to ensure that the urban renewal work is carried out in a "transparent, standardized, efficient and clear" way.

      (26) The Detailed Rules shall be implemented as of the date of issuance and shall be valid for 3 years. Before the implementation of these Rules, the implementation plan of the urban renewal project has been reviewed and approved by the district Urban Renewal Leading Group Meeting, and shall be implemented in accordance with the reviewed and approved implementation plan.
