      Measures for the Administration of Local Grain and Oil Reserves in Zengcheng District (Revised in 2023)

      Chapter I General Provisions

      

      Article 1 In order to strengthen the management of local grain and oil reserves, ensure food security and the stability of the grain market, and improve the government's ability to regulate and control the grain market, these Measures are hereby formulated in accordance with the Regulations on Food Security in Guangdong Province, the Measures for the Administration of Provincial Grain Reserves in Guangdong Province, and the Notice on Printing and Distributing the Measures for the Administration of Grain and Oil Reserves at City-level in Guangzhou City (Revised in 2020) by Guangzhou Municipal Development and Reform Commission, Guangzhou Municipal Finance Bureau and Agricultural Development Bank of China Guangdong Provincial Branch Office (S. F. G. G. Zi. [2020] No. 4) and other documents, and based on the actual situation in Zengcheng District.

      Article 2 District local grain and oil reserves are specially made by the district government to regulate and control the grain and oil market and cope with the shortage of supply caused by abnormal market fluctuations due to major natural disasters and other emergencies.

      Article 3 The District Development and Reform Bureau (District Food and Material Reserves Bureau) is in charge of district local grain and oil reserves, and the District Finance Bureau and Agricultural Development Bank of China Guangzhou Zengcheng Sub-branch (hereinafter referred to as ADBC Zengcheng) participate in the management according to their respective duties.

      Article 4 District local grain and oil reserves are entrusted to qualified grain and oil enterprises for storage. During the storage period, the reserve enterprises shall be given the cost of grain and oil reserves according to the standard, and the reserve enterprises shall bear its own profits and losses.

      Article 5 The ownership of district local grain and oil reserves belongs to the district people's government. Without the approval of the district government or its authorized grain administrative department, no institution or individual may use the reserves, and may not carry out any economic guarantee, mortgage or pay off debts with the grain and oil reserves.

      Article 6 Institutions and individuals participating in the storage, supervision and other activities of district local grain and oil reserves shall abide by these Measures.

      Chapter II Division of Responsibilities

      Article 7 The District Development and Reform Bureau is the competent authority of the district local grain and oil reserves, responsible for the gross balance and macro-adjustment of the grain and oil reserves at the district level, guiding and supervising the grain and oil reserve work, and coordinating the relevant grain and oil reserve management; responsible for the daily management of the district local grain and oil reserves, organizing, coordinating and implementing the grain and oil reserve work; drafting grain and oil reserve plans; preparing and organizing the implementation of grain and oil reserve plans; putting forward storage conditions of grain and oil reserving enterprises; organizing the implementation of the district local grain and oil reserve bidding, auction sale and other works; organizing the inspection and rotation of the district local grain and oil reserves; supervising the implementation of the district local grain and oil reserve plans and the safety of storage; in charge of the statistical works of the district local grain and oil reserves; participating in the formulation of reserve fees and rotation quality price difference subsidy standards; responsible for the settlement of annual grain and oil reserve expenses; implementing the supervision, inspection and performance evaluation of grain and oil reserves in accordance with regulations, and applying for policy-related subsidies such as the allocation of reserve fees, interest subsidies for grain and oil reserve loans, and subsidies for the rotation quality price difference in accordance with the regulations on centralized treasury payment management; promoting the application of advanced grain storage technologies, and developing information-based management of grain and oil reserves.

       Article 8 The District Finance Bureau shall be responsible for the budget management of the district-level grain risk fund, and shall formulate the subsidy standards and methods for reserve expenses together with the District Development and Reform Bureau; shall review the reserve fees, interest subsidy for grain and oil reserve loans, and rotation quality price difference subsidy audited by the competent authority, and then allocate financial funds in accordance with the regulations on centralized treasury payment management; shall implement financial fund supervision and overall performance evaluation within the scope of duties.

      Article 9 ADBC Zengcheng shall grant loans needed for grain and oil reserves according to the provisions of the national grain and oil loan management policies, the reserve scale and rotation plan issued by the government, and manage the grain and oil reserve funds.

      Article 10 The reserve enterprises shall, in accordance with the provisions of these Measures and the storage contract, properly store and rotate the district local grain and oil reserves, take the primary responsibility for true quantity, good quality and storage safety of the said grain and oil reserves, ensure that the grain and oil reserves can be stored properly, managed well, allocated timely and come in handy, and regularly report the inventory of the grain and oil reserves and submit relevant statistical statements.

      Chapter III Scale and Varieties

      Article 11 The district local grain and oil reserves are important strategic materials stored by the district government all the year round. The reserve scale, varieties and layout principles shall be put forward by the District Development and Reform Bureau according to the tasks assigned by the higher-level government or based on the needs of grain market regulation and control, and reported to the district government for approval. The structure of reserve varieties shall be determined by the district local grain and oil reserve management department according to the circulation demand of grain and oil, emergency needs and storage characteristics. The layout of district local grain and oil reserves should conform to the principles of safe storage, flexible scheduling, convenient rotation and cost saving.

      Article 12 The district local grain and oil reserves are mainly paddy, rice, wheat and other staple food, and the proportion is not less than 70% of the total scale; the reserve edible oil varieties are mainly peanut oil, soybean oil and palm oil. The scale of district local grain and oil reserves should meet the market supply requirements of permanent residents for more than 15 days.

      Chapter IV Storage Management

      Article 13 District local grain and oil reserve storage conditions should meet the following requirements:

      (1) The warehouse capacity reaches the prescribed standards;

      (2) The storage facilities have the functions of storage, ventilation, entrance and exit, pest control, etc., and conform to the technical specifications stipulated by the state, province and city;

      (3) It has the ability to test grain quality in accordance with the provisions and the conditions of monitoring grain storage temperature, moisture, pest status, etc.;

      (4) It has management and technical personnel in grain storage, quality inspection and pest control who have obtained corresponding qualification certificates;

      (5) With good management and reputation, no illegal business record, not included in the targets of joint punishment for dishonesty.

      Article 14 District local grain and oil reserve tasks shall be assigned through direct entrustment and bidding entrustment.

      (1) Direct entrustment means that the district local grain and oil reserve management department directly entrusts qualified grain and oil enterprises and grain depots with the tasks. The entrusted targets are generally state-owned grain and oil enterprises in the district with large-scale grain and oil reserve facilities and capabilities. The grain and oil reserves directly entrusted for storage shall be supervised by the district local grain and oil reserve management department, and openly purchased by the reserve enterprises.

      (2) Bidding entrustment means that the district local grain and oil reserve management department combines the storage service with the grain and oil reserves procurement for open bidding. The bidding is open to all grain and oil enterprises that meet the storage conditions.

      (3) After the storage entrustment relationship is established, the district local grain and oil reserve management department shall sign a storage contract with the reserve enterprise. The storage contract shall specify the stored variety, quantity, storage address, storage period, cost, quality requirements and other contents, and clearly define the district government having the ownership of the grain and oil reserves, and the rights, obligations and liabilities for breach of the parties.

      Article 15 Upon the expiration of the storage period, the reserve enterprise shall check the grain and oil reserve inventory in advance according to the variety, quantity and quality requirements stipulated in the storage contract. The District Development and Reform Bureau will delegate a qualified third-party grain and oil quality inspection institution to inspect the inventory, organize open auction sale after it is certified as qualified, and terminate the storage task after the relevant expenses and the loan from ADBC are settled.

      Article 16 When the storage period expires, in case of large fluctuations in the grain and oil market or the need for emergency use of grain and oil reserves, the storage period may be appropriately extended and the storage contract may be re-concluded with the approval of the district government. In principle, the varieties, prices and location of storage will remain unchanged.

    Chapter V Quality Management

      Article 17 The quality and safety standards of district local grain and oil reserves shall be determined by the District Development and Reform Bureau according to the national grain and oil standards and the requirements of the higher-level grain administrative department, among which:

      (1) Paddy and wheat must meet the national standard of medium (the third class) or above, and rice must meet the national standard of the second class or above, and in line with national food safety standards.

      (2) Edible oil must meet the national standard of the first class or above, and in line with the national food safety standards.

      Article 18 The quality of grain and oil reserves put in storage shall be inspected and certified by a qualified third-party grain and oil quality inspection institution entrusted by the District Development and Reform Bureau. The inspection expenses shall be covered by the reserve enterprise.

      Article 19 The management system of "inspection and report for every batch" shall be implemented for the warehousing quality of grain and oil reserves, which means that for every batch to be put into storage, inspection shall be carried out and report shall be issued. The inspection report shall be filed by the District Development and Reform Bureau, the inspection institution and the reserve enterprise for future reference.

      Article 20 The District Development and Reform Bureau shall establish and improve the quality and safety ledgers of district local grain and oil reserves, realize the quality traceability in procurement, storage and delivery from storage of grain and oil reserves, and improve the quality and safety management ability of grain and oil reserves.

      Article 21 Reserve enterprises shall, within 5 working days after the grain and oil reserves are put in storage and piled, notify a third-party grain and oil quality inspection institution to take samples. The third-party grain and oil quality inspection institution shall complete sampling and inspection and issue a report within 15 working days after receiving the sampling notice.

      Article 22 Reserve enterprises shall establish a quality and safety management system, regularly inspect the quality and safety items related to grain and oil reserves in the warehouse in accordance with grain and oil quality standards and food safety standards and relevant regulations, and truthfully fill in the quality and safety files. The preservation period of quality and safety files shall not be less than 5 years from the date of grain and oil sales and delivery from storage.

      Article 23 Reserve enterprises shall establish a quality and safety inspection system for the rotation of grain and oil reserves. When the grain and oil reserves are rotated out of the warehouse, the reserve enterprise shall entrust a third-party grain and oil quality inspection institution to inspect and issue an inspection report.

      Article 24 Reserve enterprises shall formulate the disposal plan of quality and safety accidents of grain and oil reserves, implement quality and safety risk prevention measures, and eliminate hidden dangers of quality and safety accidents in a timely manner. Once finding the quality and safety problems of grain and oil reserves, they shall timely and properly handle the problems according to regulations and policy requirements.

    Chapter VI Storage Management

      Article 25 Reserve enterprises are the first responsible subjects for the safe storage and safe production of grain and oil reserves, and should strictly implement the Interim Provisions on the Safety Responsibility of Grain and Oil Storage, Code for Safe Storage of Grain and Oil, Code for Safe Production of Grain Depots, Technical Specifications for Grain and Oil Storage and other industry laws and regulations to ensure the storage safety and good quality of grain and oil reserves.

      Article 26 Reserve enterprises shall store grain and oil reserves in special warehouses (tanks), keep them by special personnel, record them in special accounts, use unified accounts, forms, cards and warehouse licenses, and fill in relevant statistical statements in a timely, accurate and complete manner; set up grain and oil reserves storage record, statistical accounts and financial accounts, regularly record the purchase, sale and storage of grain and oil reserves every month for future reference, and make sure that the records are consistent with the facts, accounts, cards and ledgers. Once the storage location of grain and oil reserves is determined, it shall not be changed at will without the approval of the District Development and Reform Bureau.

      Article 27 Reserve enterprises should establish and improve the system of safe storage and safe production of grain and oil reserves, improve safety protection measures, and regularly carry out safety inspections and remediation for hidden dangers. If problems related to safe storage and production are identified, they should be properly handled according to regulations and policy requirements to avoid the expansion of losses.

      Article 28 Reserve enterprises should actively promote the application of new technologies, new processes and new equipment for grain storage, and improve the level of scientific grain storage; develop information-based management of grain and oil reserves, equip themselves with corresponding facilities and equipment, manage and use the information platform according to regulations.

    Chapter VII Rotation Management

      Article 29 The rotation of district local grain and oil reserves shall be organized and implemented by the reserve enterprises according to market demand and relevant provisions of these Measures.

      Article 30 The rotation of district local grain and oil reserves shall implement planned management. The annual rotation plan is issued by the District Development and Reform Bureau and ADBC Zengcheng. During the implementation of the annual rotation plan, the reserve enterprise may apply for adjustment of the rotation plan and submit it to the District Development and Reform Bureau for approval provided that it ensures the rotation meets the requirements.

      Article 31 The annual rotation of district local grain and oil reserves is mainly based on storage quality and storage period. The storage period of high-quality paddy shall not exceed 1 year; the storage period of ordinary paddy shall not exceed 2 years; the storage period of wheat shall not exceed 3 years. Finished grain and oil shall not be stored over 1 year and shall be rotated before the expiration of the shelf life, and other varieties shall be subject to the relevant provisions of the State. After reaching the storage period, if the quality index still meets the suitable storage standard, the rotation can be postponed appropriately with the approval of the District Development and Reform Bureau, and the approval result shall be sent to the ADBC Zengcheng for filing.

      Article 32 District local grain and oil reserves will be rotated in accordance with the approved varieties and quantities. The rotation time of each batch is not more than 3 months, and for the rest of the time, full inventory shall be ensured as per the reserve scale. The specific implementation shall be negotiated and determined in writing by the District Development and Reform Bureau and reserve enterprises. In case of special circumstances, when it is necessary to implement the rotation for more than 3 months, the reserve enterprise should report in advance to the District Development and Reform Bureau for approval of the extension, and the approval result shall be sent to the ADBC Zengcheng for filing.

      Article 33 The rotation of district local grain and oil reserves shall implement the approval system. The reserve enterprises shall submit applications in batches according to the annual rotation plan and submit them to the District Development and Reform Bureau for approval. The approval result shall be sent to the ADBC Zengcheng for filing.

      Article 34 In the event of force majeure such as disasters, epidemics, emergencies, etc., the district local grain and oil reserve management department may suspend the rotation and require the reserve enterprises to organize the replenishment in time to ensure sufficient grain sources for emergency supply.

    Chapter VIII Financial Management

      Article 35 The District Finance Bureau, according to the requirements of financial fund management, and the provisions of centralized treasury payment, shall timely allocate funds needed for grain and oil reserves.

      Article 36 Reserve enterprises shall open basic accounts, sales income reflow accounts and financial subsidy special accounts in the Agricultural Development Bank of China, accept the supervision of funds, and implement the relevant provisions of the Agricultural Development Bank of China on the management of grain and oil reserve loans.

      Article 37 Grain and oil reserve expenses include reserve fees, grain and oil reserve loan interest subsidies and rotation quality price difference subsidies.

      Article 38 Approved storage prices of grain and oil reserves at the district level. For paddy, rice, wheat, and edible oil: within 15 days from the date of issuance of these Measures, the District Development and Reform Bureau organizes Guangzhou Zengcheng Grain Reserve Management Co., Ltd. to bid for the first time on the third-party trading platform, and the purchase and warehousing price paid by Guangzhou Zengcheng Grain Reserve Management Co., Ltd. as it wins the bidding is taken as the approved benchmark price. ADBC Zengcheng will grant loans to reserve enterprises based on this standard, which will remain unchanged for three years.

      Article 39 The standard of district local grain and oil reserve fees shall be subject to the standard of Guangzhou municipal grain and oil reserve for the same period.

      Article 40 The interest subsidy standard for grain and oil reserve loans is calculated according to the approved bid-winning purchase and warehousing price for grain and oil reserves and the interest rate of grain and oil reserve loans of Agricultural Development Bank of China, and the reserve enterprises are fully subsidized with reference to the interest subsidy method for Guangzhou municipal grain and oil reserve loans.

      Article 41 District local grain and oil reserves rotation price difference subsidy standard: (1) Rice and oil reserves: Refer to the municipal rotation price difference standard in Guangzhou municipal grain and oil reserves for the same period. If the municipal rotation price difference standard has not been introduced for the same period, the pre-allocation is made according to the municipal grain and oil reserves rotation price difference standard recently announced by Guangzhou City, and the settlement is carried out according to the current standard announced by Guangzhou City at the end of the year.

      (2) Paddy and wheat: Where before the date of issuance of these Measures, local grain and oil competent authorities in the district organize auction sale of paddy and wheat for which the authorities previously organized procurement bidding, and there is a loss due to the quality rotation price difference caused thereby, the district-level food risk fund shall give a one-time subsidy in full; in case of surplus, it shall be paid into the supplementary district-level grain risk fund in full.

      After the date of issuance of these Measures, the rotation price difference generated by the paddy and wheat imported by the reserve enterprises independently after their export shall be implemented with reference to the municipal grain rotation price difference standard of Guangzhou City for the same period. If the municipal rotation price difference standard has not been introduced for the same period, the pre-allocation is made according to the municipal grain and oil reserves rotation price difference standard recently announced by Guangzhou City, and the settlement is carried out according to the current standard announced by Guangzhou City at the end of the year.

      Article 42 Grain and oil reserve expenses shall be subject to the pre-allocation system and liquidated at the end of the year. Reserve fees and interest subsidies for grain and oil reserve loans are pre-allocated quarterly, and rotation quality price difference subsidies are pre-allocated annually. The District Development and Reform Bureau will apply to the District Finance Bureau for the pre-allocation of the current year's rotation price difference subsidy according to the county-level grain reserve rotation plan document formulated in the current year, and in accordance with the municipal rotation price difference standard recently announced by Guangzhou City. At the end of the year, the District Development and Reform Bureau will organize the annual liquidation.

      Article 43 If a reserve enterprise completes the grain and oil reserves rotation task according to the annual rotation plan and relevant regulations, the grain and oil reserve expenses shall be paid during the rotation period according to the storage tasks and standards. If the organization of rotation does not meet the relevant provisions or it fails to complete the rotation task, the grain and oil reserve expenses shall be deducted accordingly.

      Article 44 The district grain and oil reserve management business shall be subject to accounting made in accordance with the Provisions on Accounting Treatment of Grain and Oil Business in the Implementation of Accounting Standards by Grain Enterprises.

      Article 45 After the storage period ends, the District Development and Reform Bureau shall organize liquidation according to the approved in-warehouse price through procurement bidding and ex-warehouse price through auction sales of grain and oil reserves. In case of losses, the district-level grain risk fund shall make up for them; in case of surplus, it shall be paid into the supplementary district-level grain risk fund in full. During the period of in-warehouse through procurement bidding and ex-warehouse through auction sales of grain and oil reserves, the reserve expenses shall be calculated based on the actual quantity of grain and oil reserves in the warehouse.

    Chapter IX Supervision and Inspection

      Article 46 District local grain and oil reserve management departments shall supervise and inspect the reserve enterprises in accordance with these Measures and the provisions of relevant laws, regulations and rules. Supervision and inspection can be carried out by means of routine inspection, regular inspection, special inspection, spot check and special investigation, etc. The District Development and Reform Bureau is responsible for organizing the annual spring and autumn grain and oil safety general investigations of the whole district.

      Article 47 In the process of supervision and inspection, the district local grain and oil reserve management department may exercise the following functions and powers:

      (1) Enter the reserve enterprise to check the storage safety and production safety of grain and oil reserves;

      (2) Ask the relevant institutions and personnel to understand the grain and oil reserves storage, sales, rotation plan and the implementation of the use order;

      (3) Access to the relevant materials and vouchers for the management of grain and oil reserves.

      Article 48 No institution or individual may refuse, obstruct or interfere with the supervision and inspection personnel in performing their duties according to law. The supervision and inspection personnel shall promptly deal with the problems found in the inspection process in accordance with these Measures and relevant laws, regulations and rules.

      Article 49 The District Development and Reform Bureau is responsible for the annual performance evaluation and management of district local grain and oil reserves, and evaluates the management of grain and oil reserves.

      Article 50 ADBC Zengcheng shall supervise the district local grain and oil reserve loans in accordance with the regulations on the closed management of funds, and conduct regular inventory inspections.

    Chapter X Use Management

      Article 51 In the cases of disaster relief, emergency rescue and other special circumstances when the grain and oil reserves need to be used, the District Development and Reform Bureau shall start the procedures for the use of the district local grain and oil reserves in accordance with the relevant provisions of Zengcheng District Food Emergency Plan.

      Article 52 In the event that the district local grain and oil reserves that the district government needs to put on the market in order to stabilize the market grain price, the District Development and Reform Bureau shall take the lead in formulating the implementation plan, specify the variety, quantity, price and storage location of the grain and oil reserves to be used, report it to the district people's government for approval before implementation, and send the approval result to ADBC Zengcheng for filing.

      Article 53 If losses occur in the sales of district grain and oil reserves according to government orders, the district grain risk fund shall make up for them; for any profits gained, the profits shall be deposited into the district food risk fund in full.

    Chapter XI Legal Liability

      Article 54 If the reserve enterprises violate laws and rules, they shall be investigated and punished by the relevant administrative departments of the district government according to law. If the case constitutes a crime, criminal responsibility shall be investigated according to law.

      Article 55 Where relevant administrative departments (organizations that undertake public administration functions, etc.) and their staff violate the provisions of these Measures and fail to perform their duties according to law, they shall be ordered by the competent authorities to make corrections, and the responsible leading personnel and persons directly responsible shall be given sanctions according to law; if the case constitutes a crime, criminal responsibility shall be investigated according to law.

    Chapter XII Supplementary Provisions

      Article 56 These Measures shall come into force as of the date of promulgation and shall be valid for 3 years. Notice on Printing and Distributing the Measures for the Administration of Local Grain and Oil Reserves in Zengcheng District (Revised in 2021) by Guangzhou Zengcheng District Development and Reform Bureau, District Finance Bureau and Agricultural Development Bank of China Guangzhou Zengcheng Sub-branch (S. Z. F. G. G. Zi. [2021] No. 1) shall be repealed simultaneously. The administration of grain and oil reserves occurring before the date of promulgation shall be carried out according to the original measures.
