    Notice of Peoples Government Office of Zengcheng City in Guangzhou on Issuance of Regulation of Zengcheng District on Management of Special Funds for Standardization Strategy.



      To the town governments, subdistrict offices, district government departments and directly subordinate agencies:

      The Regulation of Zengcheng District on Management of Special Funds for Standardization Strategy has been approved by the district people’s government and is now issued to you which shall be implemented by you. If there is any problem in implementation of the Regulation, please report to market supervision administration of the district.

      Regulation of Zengcheng District on Management of Special Funds for Standardization Strategy

      Chapter IGeneral

      Article 1 To improve our capability of independent innovation and urban competitiveness, to promote transformation of economic development modes and to promote implementation of standardization strategy in the district, as specified and required in Budget Law of the People's Republic of China, Standardization Law of the People‘s Republic of China, Regulation of Guangzhou Municipality on Management of Special Funds for Standardization Strategy and other laws and rules, considering the practical situations of standardization in the district, the Regulation is prepared.

      Article 2 The special funds for standardization strategy mentioned in the Regulation are the special funds from budgetary outlays of Zengcheng district for preparation and revision of standards of enterprises and institutions in the district, for standardization research projects and activities of secretariat of professional standardization technology committee, for standardization demonstration (pilot) projects construction, for application of international standards or advanced foreign standards and for important activities of international standardization in Guangzhou.

      Article 3Legal persons and other organizations legally incorporated in the administrative area of Zengcheng District in Guangzhou (other than provincial enterprises and institutions or enterprises and institutions of the central government in Guangzhou) that carry out standardization eligible for the fund listed in the Regulation can apply for the special funds in accordance with the Regulation.

      Provincial enterprises and institutions or enterprises and institutions of the central government in Guangzhou that undertake preparation and revision of international standard and local standards proposed or approved by market supervision and administration department of Guangzhou, carry out standardization research projects and work of secretariat of professional standardization technology committee, standardization demonstration (pilot) projects construction and apply international standard or advanced foreign standards can apply for the special funds in accordance with the Regulation.

      Chapter II Responsibilities of the Departments

      Article 4 Financial department of the district shall review, approve and complete allocation of special funds as per the specifications for budget management and shall organize supervision and inspection over the special funds and overall performance evaluation and shall not directly participate in review and approval of projects.

      Article 5 Market supervision and administration department of the district is responsible for management of the special funds, including collection of projects to be subsidized, organizing review, publicity of projects, report of budget for the special funds, preparation of plan for distribution and use of special funds, assessment of performance of the projects and information disclosures. Market supervision department of the district shall report projects to be subsidized in current year before preparation of budget for the next year.

      Article 6 Organizations applying for the fund shall truthfully provide application materials. An organization that receives special funds shall complete the work specified by market supervision and management department and financial department of the district as required

      Chapter III Principles and Scope of Use and Amount of the Funds

      Article 7 Special funds shall be used to encourage integration between advanced standards and industrial development and urban management and shall be allocated impartially and equitably and shall be managed in a normative manner and shall be used for the special purposes and for rewarding outstanding performances:

      I. Be conducive to industrialization of scientific and technological achievements, improve influence of our products and services at home and abroad and uplift comprehensive competitiveness of the city;

      II. Be conducive to transformation of mode of economic development in the district and service for modern service industry development in the district;

      III. Be conducive to protecting human health, promoting energy conservation and consumption reduction, improving resource recycling efficiency and environmental protection, uplifting level of safe production and promoting construction of a harmonious society;

      IV. Be conducive to taking a lead in applying quality, safety, environment, technology, labor standards and other standards in line with international practices.

      Article 8 Purposes of special funds:

      I. For taking a lead in preparation and revision of international standards, national standards, industrial standards and local standards and preparation of group standards.

      II. For carrying out activities of secretariat of professional standardization technical committees (technical sub-committees) at all levels;

      III. For carrying out standardization demonstration (pilot) projects construction;

      IV. For applying international standards or advanced foreign standards and obtaining “certificate of accreditation on products applying international standards” (other than review items);

      V. For carrying out major international standardization activities held in Guangzhou, including ISO forums, annual conferences and important academic seminars;

      VI. For executing the enterprise standard "pacemaker” projects in enterprises that are recognized as “pacemaker” of enterprise standards by enterprise standard “pacemaker” assessment agency where the enterprise standards are applied in production and marketing.

      VII. For carrying out enterprise benchmarking and compliance actions, with results of benchmarking and compliance activities declared on the "national benchmarking and compliance information service platform".

      Article 9 The amount of special funds shall be allocated as stated below:

      I. RMB 300,000 will be allocated for taking a lead in preparation and revision of an international standard, RMB 100,000 will be allocated for taking a lead in preparation and revision of a national standard, RMB 80,000 will be allocated for taking a lead in preparation and revision of an industrial standard, RMB 50,000 will be allocated for taking a lead in preparation and revision of a local standard and RMB 20,000 will be allocated for taking a lead in preparation and revision of a group standard. Group standards does not include local standards and group standards in our district.

      II. RMB 200,000 will be allocated for carrying out work of secretariat of professional standardization technology committee, RMB150,000 will be allocated for carrying out work of secretariat of professional subcommittee, RMB100,000 will be allocated for carrying out work of secretariat of National Professional Standardization Technical Committee, RMB 50,000 will be allocated for carrying out work of technical subcommittee, RMB30,000 will be allocated for carrying out work of secretariat of Professional Standardization Technical Committee of Guangdong Province and RMB 20,000 will be allocated for carrying out work of secretariat of technical subcommittee.

      III. RMB 150,000 will be allocated for carrying out state-level standardization demonstration (pilot) projects, RMB 80,000 will be allocated for provincial-level standardization demonstration (pilot) projects and RMB 60,000 will be allocated for municipal-level standardization demonstration (pilot) projects.

      IV. RMB 2000 will be provided for obtaining “certificate of accreditation on products applying international standards”.

      V. Amount of subsidy for important international standardization activities in Guangzhou is to be determined by market supervision and management department and financial department of the district along with finance department of the district considering the specific situations.

      VI. RMB 30,000 and RMB 20,000 will be allocated respectively for state-level enterprises and provincial-level enterprises that are recognized as enterprise standard “pacemaker”. No more than 5 projects in a same organization will be subsidized in a year.

      VII. RMB 2,000 will be provided for an enterprise that meet the criteria for benchmarking and compliance.

      Article 10 The top three drafters in the standard text are the organizations that take a lead in preparation and revision of national standards, industrial standards, local standards and group standards.

      Drafters that are not listed in the standard text are to be certified by the organization that issues the standard or is responsible for management of the standard.

      An organization that participates in drafting an international standard whose proposal is adopted as core content of the international standard is deemed as an organization taking a lead in preparing international standard.

      Chapter IV Application and Approval

      Article 11 Market supervision and management department of the district is responsible for issuing notice on application for yearly special funds, determining affairs related to application for funds and accepting and reviewing applications for special funds and disclosing information.

      Article 12 The applicants shall file paper application materials to market supervision and management department of the district as required in the notice.

      Article 13 The applicants shall submit the following application materials to market supervision and administration department of the district:

      I. Basic materials

      1. Application for special fund for standardization strategy at Zengcheng District in Guangzhou

      2. Self-assessment report on project performance issued by the enterprise;

      3. Business license, legal person registration certificate or documents of incorporation approved by competent departments (the original is to be checked on site, and no hard copy is required).

      II. Other materials to be submitted considering the projects for which the application is filed

      1. Application for preparation and revision of international standards, national standards, industrial standards and local standards: the official copy of standard issuance.

      Application for group standard preparation and revision projects: notice and announcement of issuance of a group standard, text of group standard issued, evidence of self-declaration on “state standard information service platform” for over a year and self-declaration of more than 2 enterprises applying the standard or evidentiary materials of products and services expressly stated.

      2. Application for projects of Secretariat of the Professional Standardization Technical Committee: approval for establishment from the technical committee for standardization.

      3.Application for carrying out standardization demonstration (pilot) projects construction: demonstration (pilot) project acceptance materials.

      4.Application for use of international standards or advanced foreign standards: certificate of accreditation on products applying international standards.

      5. Application for undertaking major international standardization activities held in Guangzhou: relevant supporting materials of the activities.

      6. Application for executing an enterprise standard "Pacemaker” project: document from enterprise standard “pacemaker” assessment agency that recognizes an enterprise as a “pacemaker” and evidence of implementation of enterprise standard in production and marketing.

      Multiple products or service standards of a same enterprise included in a same enterprise standard “pacemaker” list that are the same products or services shall be deemed as one standard.

      7. Declaration of benchmarking and compliance results: benchmarking and compliance results can be found on the "State Benchmarking and Compliance Information Service Platform".

      Article 14 Application for enterprise standard “pacemaker” project shall be filed within 1 year since the document from the enterprise standard “pacemaker” assessment agency recognizing a standard as “pacemaker” is issued.

      Other organizations eligible for the subsidy shall file application within 2 years since completion of the project. Overdue application will be deemed as waiver of application.

      Time limit for project application is as stated below:

      I. Period of application for standard preparation and revision projects shall start when the standard is issued;

      II. Period of application for carrying out work of Secretariat of the Professional Standardization Technical Committee shall start on the day when the technical committee is approved;

      III. Period of application for carrying out standardization demonstration (pilot) project construction shall start when the project is accepted and assessed;

      IV. Period of application for use of international standard or advanced foreign standard shall start on the day when the certificate of use is approved;

      V. Period of application for major international standardization activities in Guangzhou shall start on the day when the activities are carried out;

      VI. Period of application for benchmarking and compliance shall start on the day when they are declared on "State Benchmarking and Compliance Information Service Platform”.

      Article 15 An application shall be rejected in any of the following circumstances:

      I. The project for which an application is filed is not within the scope specified in Article 8 of the Regulation;

      II. The project for which an application is filed has been granted subsidy of similar nature from other district government department;

      III. The applicant fails to submit application materials as required.

      Article 16 An application for a project can be submitted by only one applicant More than two organizations that are eligible for a same subsidy shall consult with each other to select one of them for applying for the subsidy.

      Chapter V Fund Management and Information Disclosure

      Article 17 Market supervision and management department of the district will gather and review projects to be granted with special funds, determine enterprises and projects to be subsidized and amount of subsidies, prepare special fund allocation plan (unless involving with confidentiality) and declare the same to the public on portal of Zengcheng District people’s government and bulletin board of Zengcheng District (in Guangzhou) Market Supervision and Administration Bureau for no less than 5 working days. During the publicity period, any organization or individual who has any objection may raise it to the district market supervision and administration department. The district market supervision and administration department shall carry out an investigation and declare investigation result. Acceptance and settlement of complaints (including complaint items and reasons, result of complaint settlement etc.) shall be declared on relevant websites.

      Article 18 If no objection to the special fund allocation plan is raised within the publicity period or an objection (if any) is proven to be unacceptable, the plan will be under department budget management and reported to finance department of the district as required.

      With approval of finance department of the district, procedures for fund allocation will be gone through. A grantee is declared on announcement website of the people's court to be in bankruptcy liquidation before issuing a notice of fund allocation will be deprived of the subsidy.

      Chapter VI Supervision, Management and Performance Assessment

      Article 19 Accountability mechanism is to be applied in management of special funds. One who violates laws and disciplines in management and use of special funds shall be punished in accordance with relevant laws and regulations.

      Article 20 Special funds shall be subject to performance assessment. Finance department of the district will organize assessment of performance of special funds as specified, and market supervision and administration department of the district will carry out self-assessment of performance of special funds. The subsidized organizations shall assist market supervision and administration department of the district in assessment of performance of the subsidized projects and report results of self-assessment of performance.

      Article 21 If an applicant practices fraud and refuses to assist in performance assessment in executing a subsidized project, market supervision and administration department of the district will cancel and even withdraw the funds.

      Chapter VII Supplementary Provisions

      Article 22 International standards mentioned in the Regulation refer to the standards prepared by International Standardization Organization (ISO), International Electrotechnical Commission (IEC) and International Telecommunication Union (ITU) as well as the standards prepared by other international organizations and confirmed and published by International Standardization Organizations (ISO).

      Article 23 The Regulation will be put into practice since the date of issuance and will be valid for 3 years.
